Install Fault /dev/sda1 is apparently in use by the system.

I get this fault when trying to install to a 40gb ssd, I have tried installing to a 640gb wd hdd to confirm no other hardware issue and installs fine, just a fault installing to this ssd.

Is it the size that it is failing on?? or is it something else??
